Rules and Regulations for the Kings Dominion Happiness is Finding the Cure

The Central Virginia Affiliate of the Susan G. Komen Breast Cancer Foundation, Inc., dba Central Virginia Affiliate of Susan G. Komen for the Cure ("SGK"), a tax exempt, nonprofit charitable organization under Section 501(c)(3) of the Internal Revenue Service Code, located in Richmond, Virginia, is conducting a fundraising raffle activity in accordance and compliance with Virginia Code S.18.2 -340.26. The purpose of the raffle is to raise funds for SGK in order to fund research, education, outreach, and screening programs and deliver the life-saving message of early detection to the Central Virginia community. These raffle activities shall be known as the Kings Dominion Happiness is Finding a Cure ("the Raffle".) The rules and regulations of the Raffle are set forth below. By purchasing a pink Snoopy ("Snoopy"), the purchaser agrees to be bound by these rules and regulations. The interpretation and application of the rules and regulations by SGK and its legal counsel shall be final. Additionally, Snoopy purchasers shall be subject to the laws and regulations of their place of residence.

Tickets, the Prize, and the Prize Drawing

SGK, either solely or in collaboration with designated partners, will sell Snoopy at a cost of $5.00 (five dollars) per Snoopy or $20.00 (twenty dollars) per 5 (five) Snoopys (if the Snoopys are purchased in a group of 5 by a single purchaser). Snoopy sales will be conducted at Kings Dominion, 16000 Theme Park Way, Doswell VA during Kings Dominion’s regular business hours, commencing July 25, 2011, and may be available for sale prior to August 22, 2011 at Kings Dominion at hours to be determined by volunteer availability. Snoopys purchased at Kings Dominion must be purchased by 10:00 PM Eastern Time on August 21, 2011. Snoopys may also be immediately ordered online via the website www.happiness.kingsdominion.com . Complete instructions for ordering Snoopys online can be found at the website, and online Snoopy sales will terminate at 12:00 midnight Eastern Time on August 21, 2011. A maximum of 8,800 Snoopys will be entered in the contest. If the maximum number of Snoopys are sold prior to August 21, 2011 at 10:00 PM Eastern Time, then the sale of Snoopys will terminate at that time. The odds of winning the Prize will depend on the final number of Snoopys sold. All net proceeds of this event will go to SGK. All Snoopys will be provided by Kings Dominion and shall remain the property of Kings Dominion. Per IRS regulations, amounts paid for raffle tickets or similar activities are not gifts to the charitable organization and do not qualify as a charitable deduction. REGARDLESS THE METHOD OF PURCHASE, ALL SNOOPY SALES WILL CEASE AT 12:00 MIDNIGHT EASTERN TIME ON AUGUST 21ST, 2011, TO ALLOW PREPARATION FOR THE PRIZE DRAWING ON MONDAY, AUGUST 22 AT ABOUT 9:30 AM EASTERN TIME.

The Grand Prize in the Kings Dominion Happiness is Finding a Cure Pink Snoopy Contest is a 2011 Honda Civic (the "Civic"), serial number 2HGFA1F34BH509846 The Civic was acquired from Pohanka Honda of Fredericksburg as a donation. SGK reserves the right, at its sole option, to substitute a prize of comparable value. If the raffle winner accepts the prize, the winner must provide a completed IRS Form W-9 to SGK with their valid taxpayer identification number. Regardless the prize, the winner assumes responsibility for all Local, State and Federal taxes, including but not limited to income taxes based on the value of the prize received, and any other similar fees, including but not limited to, applicable license and registration fees on vehicles. SGK takes no responsibility for any tax liabilities. Consult your tax advisor. If the winner is eligible to receive the Civic and elects to receive the Civic as their prize, the winner agrees to take delivery of the Civic at Pohanka Honda of Fredericksburg within 30 (thirty) days of being notified he or she is the Winner, or assumes responsibility for costs associated with transporting the Civic to the winner’s location of choice. The Winner must claim their prize within 30 days of notification, otherwise such prize will be forfeited. In the event that any prize winner does not claim the prize or is determined to be ineligible to receive a prize, no other prize will be awarded or substituted. The Grand Prize is not transferable.

The Prize Drawing will take place at or about 9:30 am eastern time on Monday, August 22, 2011, at Kings Dominion. One Snoopy will be selected at random (picked out of the main Kings Dominion fountain/pool at the entrance to the park) in accordance with Virginia laws by an independent third party, not affiliated or associated with SGK. A number will be attached to Snoopy relating to the number on entry receipt. Multiple Snoopys from one ticket will be assigned additional numbers for identification. The Civic (the "Grand Prize") will be awarded to the individual whose name appears on the entry ticket corresponding to the number of the selected Snoopy (the "Winner"). The Grand Prize drawing is open to the public, but the Winner does not need to be present to win. The Winner will be announced at Kings Dominion on Monday, August 22, 2011. The Winner will be notified by the telephone, mail and email addresses listed on the Winner’s entry form. Employees of Kings Dominion, employees of Pohanka Honda of Fredericksburg, and Officers, Directors and staff of SGK, and their immediate families (living in same household) are not eligible to win. The Winner must be 18 years of age or older and must prove eligibility.

By purchasing a Snoopy, individuals enter the raffle activity and agree to be bound by all the rules and limitations of the Raffle. The Raffle is subject to all federal, state, and local laws and regulations and is void where prohibited by law. If declared a winner, such individual agrees that their name and/or likeness may be disclosed to and used by the news media and may otherwise be used by SGK or Kings Dominion for promotional purposes without additional compensation. By entering the Raffle, each participant releases the corporate entities of SGK, Kings Dominion, and Pohanka Honda of Fredericksburg, and their respective parent or affiliated companies, directors, officers, employees, volunteers and agents from any and all liability for injuries, losses or damages of any kind caused by participating in the Raffle or winning any prize, or resulting from acceptance, possession, use or misuse of any prize. Moreover, the prize winner or winners agree to indemnify and hold harmless the corporate entities of SGK, Kings Dominion, and Pohanka Honda of Fredericksburg, and their respective directors, officers, employees, volunteers and agents from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of participating in the raffle or the winner’s acceptance of use of any prize. The winner of the Civic and/or their family, heirs, associates or other interested parties agree to indemnify and hold harmless the corporate entities of SGK, Kings Dominion, and Pohanka Honda of Fredericksburg, and their respective parent or affiliated companies, directors, officers, employees, volunteers and agents from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of the Civic.

Only one eligible person may be entered in the Raffle per Snoopy sold. If the name of more than one person is submitted with a Snoopy purchase, and that Snoopy is selected as a winning Snoopy, then the person named first will be deemed the holder of record of that Snoopy and declared the winner. Division of prize by a group purchasing a Snoopy in common shall be to the sole responsibility of the person named as the holder of record of that Snoopy, should that Snoopy be selected as a winner.

SGK reserves the right to reject any Snoopy purchase that is submitted with payment that does not constitute "good funds." As soon as practically possible after receipt, SGK will make a reasonable effort to notify the individual and/or entity that purchases a Snoopy or Snoopys with check or credit card which has been rejected because the credit card or check did not clear that the entry has been rejected, by attempting to make contact through the information provided at the time of Snoopy purchase.

A Raffle participant’s sole and exclusive remedy for SGK’s breach shall be limited to the return of the purchase price paid for his or her Snoopy(s). In no event shall the corporate entities of SGK, Kings Dominion, and Pohanka Honda of Fredericksburg, and their respective directors, officers, employees, volunteers and agents liable to any party for any loss or injuries to earnings, profits or goodwill, for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages by counsel.

By purchasing a Snoopy and choosing to participate in the raffle, each raffle participant acknowledges and agrees that SGK has the right, in its sole discretion, to elect not to proceed with the raffle for any reason whatsoever or for no reason, and in such event, a participant's sole and exclusive remedy shall be to receive a refund of the full price paid by such participant for each raffle ticket purchased, without interest.

Komen for the Cure® logo are registered trademarks and no other person or entity is authorized to copy or otherwise use it without the express written consent of Kings Dominion, Honda or Susan G. Komen for the Cure® Central Virginia Affiliate.
